Breeder's Rights

  • Plant Breeders' Rights (PBR) or Plant Variety Protection (PVP) grant exclusive control over the propagating and harvested material of a new plant variety for a specified period (typically 20-25 years).

Eligibility Criteria

  • A plant variety must be:

    • Novel: Not commercially sold beyond a specified period.

    • Distinct: Clearly distinguishable from existing varieties.

    • Uniform: Consistently reproducing similar traits.

    • Stable: Maintaining essential characteristics over successive generations.

  • Once granted, these rights allow breeders to:

    • Sell the variety under a trademark.

    • License others to produce and sell it.

    • Take legal action against unauthorized production or sale.

  • These rights encourage investment in plant breeding and contribute to agricultural innovation.
