Classes of Drugs and Cosmetics Prohibited from Import

  • Under Sections 10 and 10A of the Act, certain categories of drugs and cosmetics are strictly prohibited from being imported:
  • Certain classes of drugs and cosmetics are prohibited from being imported into India due to safety concerns, potential for misuse, or other regulatory reasons.
  • These include:
  1. Drugs Containing Narcotic or Psychotropic Substances:

    • Import of narcotics and psychotropic substances is highly restricted and typically requires special permissions under international conventions and national laws.
  2. Drugs Without Approval:

    • Any drug not approved by the Central Licensing Authority or without requisite clinical trial data is prohibited from import.
  3. Adulterated or Misbranded Drugs:

    • Drugs that are adulterated or misbranded as per the Act’s definitions are barred from import.
  4. Counterfeit Drugs:

    • Any drug that infringes on patents or trademarks, or is a counterfeit version of a legitimate drug, is prohibited.
  5. Drugs with Harmful Ingredients:

    • Drugs containing ingredients that are banned or restricted in India, such as certain preservatives or colorants, cannot be imported.
  6. Expired Drugs:

    • Any drug that has passed its expiry date as indicated on the packaging is prohibited from import.
